After the divorce my ex-wife got custody to our daughter. Now she wants me to pay for my daughter’s private school and tutors. Moreover, my ex-wife plans a nose plastic surgery for the child and insists on my paying for that. I am against this surgery in general and not in a position to pay for it. Do I really have to pay for this surgery anyway?

Despite you are divorced with you wife both of you remain your child’s parents. However, as a rule, a parent that has custody has the right to make principal and major decisions regarding children’s life.

Could you give an example for “major” decision?

• the necessity of a nose plastic surgery;
• choosing child’s religion: if he/she will be raised as Jewish, Muslim or Russian orthodox;
• if a child joins the army or not;
• if he/she can get married before 18 or not;
• give a child a permission to get a drivers license and drive a car, etc.

The decision about the child’s education also falls to “major” category: a parent in custody decides weather a child attends a private or public school or gets a religious education.

Do you provide pre-nup services for residences of New Jersey? My future wife is arriving via K1 visa in February from Ukraine. I will need a simple pre-nup (I have very few assets, no property). My son,a US citizen, married a Russian girl, helped her to obtain the GC, had a child born, in NJ. After the child was born, she wanted to go back to Russia and to take a 6 month old baby with her. She asks my son to prepare a passport for a child, so that she can visit her family.(Her mom has been visiting her for 6 months previously). My son is afraid she is going to divorce him in Russia, never come back and that she would ask for a child support from Russia. What he is supposed to do? Let her go without divorce or divorce her or annul the marriage? It is obvious for me that she just used my son to get a Green card and legalize her status. She had previous marriage to another guy, but her first American husband did not agree to do the GC paperwork for her, so she divorced him.
