Question

I would like to pay an attorney to get my Russian marriage annulled. My wife and I were married in St. Petersburg on 1 Feb 2013. How long will it take to get the marriage annulled? How much would it cost?

I thought that extra money might make the process go faster. Once the US divorce is finalized, I will then hire you to see about getting the marriage annulled. I will keep in touch with you.

Answer

According Art 29 part 4 of the Family code of Russian Federation, the marriage may not be recognized as annulled after its dissolution, with the exception of the existence of the law-prohibited degree of kinship between the spouses, or if one of the spouses consists, at the moment of registering the marriage, in another undissolved marriage. Art 14 of the Family code of Russian Federation states: not to be admitted shall be entering into a marriage by:

1) persons one of whom at least already consists in another registered marriage;

2) close relations (relations by the direct ascending and descending lines - by the parents and children, by the grandfather, the grandmother and the grandchildren), by full and by not full (having a common father or a mother) brothers and sisters);

3) adopters and the adoptees;

4) persons at least one of whom is recognized by court as legally incapable because of mental derangement.

So, if you want an annulment, you need start now.
