JUDGEMENT

In the name of the Russian Federation

November 02, 2018 City of Moscow

The court composed of the presiding justice of the peace of the judicial district of the Nagatino-Sadovniki district of Moscow,

having considered in open court the civil case on the claim of Reed, John Alexander [real name keeps in the secret] against Reed, Olga Ivanovna [real name keeps in the secret] for divorce,

FOUND:

Reed, John Alexander filed divorce claim against Russian citizen Reed, Olga Ivanovna, referring to the fact that he has been in a registered marriage with the defendant since July 26, 2013; they have no children in common in the said marriage. The plaintiff also pointed out that the life as a couple with the defendant did not exist, the marriage relationships were terminated, the common household was not maintained, there was no dispute on the marital property division.

The Plaintiff did not appear at the court hearing, he sent a representative by proxy Karina Duvall, Attorney at Law who appeared at the court hearing, supported the divorce claims in full, asked the court to dissolve the marriage between the Parties, on the grounds specified in the statement of claim.

The Defendant appeared at the court hearing, did not object to the satisfaction of claims and dissolution of marriage.

The justice of the peace, after hearing the parties, examining the written files of the case, considers the divorce claim to be subject to satisfaction.

In accordance with Part 2 of Art. 21 of the Family Code of the Russian Federation, a marriage shall be dissolved by a court order in cases when one of the spouses, despite the absence of any objections, refuses to dissolve the marriage in the civil registry office, inter alia refusing to file an application.

By virtue of Part 1 of Art. 22 of the Family Code of the Russian Federation, a marriage shall be dissolved by a court order if the court determines that the future life as a couple of the spouses and the preservation of the family are impossible.

According to Part 2 of Art. 22 of the Family Code of the Russian Federation, when considering a divorce case in the absence of the consent of one of the spouses to dissolve the marriage, the court shall be entitled to take measures to reconcile the spouses and to postpone the hearing of the case, having appointed a term for reconciliation of the spouses for the period not exceeding three months.

The marriage shall be dissolved if the measures for reconciliation of the spouses were unsuccessful and the spouses (one of them) insist on the dissolution of the marriage.

At the court hearing it was found that the parties were married on July 26, 2013, as evidenced by the marriage certificate, they do not have minor children in common.

On September 05, 2018, the parties were granted with a period of two months for reconciliation, but the period granted to the spouses for reconciliation did not yield any results; reconciliation did not take place.

The marriage relationships between the spouses have been terminated, the common household is not maintained.

Thus, the court concludes that the family has actually broken up and its preservation is impossible, the measures taken by the court to reconcile the spouses yielded no results; therefore the claims shall be subject to satisfaction.

Based on the aforesaid and guided by Art. 194-198 of the Civil Procedural Code of the Russian Federation, the justice of the peace

HAS RESOLVED:

To satisfy the claim of Reed, John Alexander against Reed, Olga Ivanovna for divorce.

To dissolve the marriage, registered on July 26, 2013, between Reed, John Alexander and Reed (before marriage - Ivanova) Olga Ivanovna by the Wedding Registry Office No. 4 of the Directorate for Registry Offices of Moscow.

The judgement can be appealed on appeal to the Simonovsky District Court of Moscow through the justice of the peace within a month.
