DIVORCE JUDGEMENT

In the name of the Russian Federation

O.M. Kulbaka, Justice of the Peace of the 259 Judicial District of the Khimki Judicial District of Moscow Region,

involving the Secretary V.V. Krapivnykh,

having examined in open court the civil case involving a claim by Plaintiff [the name keeps in secret] to Defendant [the name keeps in secret] for the divorce,

FOUND:

Plaintiff filed a claim against Defendant for the divorce.

In support of the stated claims the plaintiff indicated that on May 31, 2008 he married Defendant. There are no children in common in the marriage. After the marriage registration Defendant moved to Shanghai (China) for joint residence, where Plaintiff was on duty. However, their living together did not work out, and soon Defendant left Plaintiff and returned to Moscow. The couple tried to restore family relationships many times, but all attempts to keep the family were unsuccessful. The desire to continue living together is completely lost, the family relationships are terminated. The plaintiff offered the defendant to terminate the marriage at the registry offices at her place of residence, however, she actually shrinks from submitting an application to registry authorities not expressing any objection against divorce, due to which Plaintiff was forced to go to court with the above claim.

The plaintiff did not appear in the court session, he was notified of the time and venue of the proceedings, he asked for consideration of the case in his absence.

In accordance with Article 167 of the Code of Civil Procedure of the Russian Federation the Court considers it possible to consider the case in the absence of the plaintiff, his representative, and the defendant.

Having examined the materials of the case and produced evidence in accordance with the requirements of Article 67 of the Code of Civil Procedure of the Russian Federation, the court comes to the conclusion that the alleged claim is subject to the satisfaction due the following reasons.

In accordance with Article 21 of the Family Code of the Russian Federation a marriage shall be dissolved in court if the spouses have common minor children, with the exception of the cases stipulated by Item 2, Article 19 of the present Code, or if one of the spouses does not consent to dissolution of the marriage. A marriage shall also be dissolved in court if one of the spouses, while raising no objections to it, avoids the dissolution of the marriage at the registry offices, including refuses to file an application.

According to Article 22 of the Family Code of the Russian Federation a marriage shall be dissolved in court if it has been established that the further life of the spouses together and the preservation of the family is impossible.

By virtue of Article 23 of the Family Code of the Russian Federation if there is a mutual consent to the dissolution of the marriage on the part of both spouses having common minor children, or on the part of the spouses indicated in Item 2, Article 21 of the present Code, the court shall dissolve the marriage without finding out the motives behind the divorce.

From marriage certificate IV-ИК No. 543452 issued by the Khimki Civil Registry Directorate of the Chief Civil Registry Directorate of Moscow Region dated November 14, 2015, it is seen that parties have been officially married from May 31, 2008.

Given the fact that the Court found that the further joint life of the spouses and preservation of the family is not possible, and taking into account that the case materials do not contain information that the plaintiff and the defendant have common minor children, as well as a dispute over the division of property, which is owned jointly the court concludes that the stated claims shall be satisfied.

In view of the foregoing, subject to Articles 194-198 of the Code of Civil Procedure of the Russian Federation, the court

RULED:

To satisfy the claim for divorce of plaintiff against defendant.

To dissolve the marriage registered between parties by the Khimki Civil Registry Directorate of the Chief Civil Registry Directorate of Moscow Region dated November 14, 2015 under marriage record No.360.

The decision may be appealed in the Khimki City Court of Moscow Region through a Justice of the Peace within a month from the date of its preparation in the final form.
